TERMS AND CONDITIONS FOR TREATMENTS AND/OR PROCEDURES AT TOTAL DEFINER BEAUTY SPA
This document describes the general terms and conditions (the “Terms and Conditions”) applicable to the access and use of the services (the “Services”) offered by LIMITLESS INVERSIONES S.A.S through TOTAL DEFINER BEAUTY SPA (“The SPA”).
Any person who wishes to make use of the Services at TOTAL DEFINER BEAUTY SPA may do so subject to the Terms and Conditions and the Privacy Policies, along with all other policies and principles as well as informed consents.
Accordingly, all transactions carried out to access services provided at TOTAL DEFINER BEAUTY SPA, as well as their legal effects, will be governed by these rules and subject to the applicable legislation in Colombia.
ANY PERSON WHO DOES NOT ACCEPT THESE TERMS AND CONDITIONS, WHICH ARE MANDATORY AND BINDING, MUST REFRAIN FROM USING THE SERVICES.
LEGAL CAPACITY
The Services provided through TOTAL DEFINER BEAUTY SPA are only available to individuals who have the legal capacity to contract.
Those who do not have such capacity and minors without prior authorization from parents, guardians, caretakers, or curators, who will be considered to act on behalf of the minors in exercising their legal representation, may not use the Services.
In the case of minors, the guardians of the person must formally authorize through a letter specifying that they give consent for the minor to receive the procedure along with the following requirements:
Photocopy of the identity card.
Photocopy of the legal guardians’ identification card.
Photocopy of the civil registration.
Authorization letter signed by the parents.
On the day of the procedure, the minor must be accompanied by one of their legal guardians.
LEGAL TERMS
This Agreement shall be governed and construed in accordance with the laws of Colombia, without giving effect to any principles of conflicts of law. If any provision of these Terms and Conditions is declared illegal, void, or for any reason unenforceable, it shall be interpreted within the framework of the same and in any case shall not affect the validity and enforceability of the remaining provisions.
3. SCHEDULING, CANCELLATION, AND RESCHEDULING POLICY
3.1. A scheduled appointment that is not attended is considered a service rendered.
3.2. The patient agrees to cancel or reschedule the appointment within an allowed time frame of up to 24 hours in advance through the platform or via the corresponding link that appears in the confirmation email of their appointment, or from any of the reminders received about their appointment. Otherwise, appointments will be considered as completed and, as a result, the treatment outcomes may be adversely affected due to the lack of continuity.
3.3. Even if the cancellation is made with more than 12 hours’ notice, we cannot guarantee an appointment for the same day or even for the next day, especially in cases of high occupancy where we cannot allocate time for other patients whose time is also limited. The current availability is always the one displayed on our technological platform.
3.4. The patient must schedule, cancel, and reschedule their appointments through the platform or also via the corresponding link that appears in the confirmation email of their appointment.
3.5. If the patient has made a purchase for a treatment, they should select the purchased treatment to schedule an appointment and follow the steps.
3.6. If the patient has not yet purchased a treatment, they must purchase a treatment in order to schedule an appointment.
3.7. If deemed appropriate, the patient should have a prior assessment before undergoing any treatment, which will have no cost either in person or virtually.
3.8. The official confirmation of the patient’s appointment, with date, time, and address, is received by email upon completion of the scheduling process. Such email notification is the official confirmation of their appointment.
3.9. The patient must fill out an intake form prior to their first appointment for the creation of their medical record and/or to track the results of their treatment. A link to this intake form can be found in the appointment confirmation email and in the reminders.
3.10. For all the reasons above, the patient must ensure to accurately enter their email both on the intake form and in the appointment scheduling application on the platform when completing the scheduling process, and to have received the appointment confirmation email when scheduling their appointment for the first time. Otherwise, their appointment will not have been correctly scheduled. If the email is not received, there could be various reasons: (i) the process was not completed, (ii) the email was entered incorrectly, or (iii) it went to Spam or Junk. If the email is not received and the patient is sure none of the above reasons apply, please contact us through the customer experience team phone line or chat for assistance.
4. RESTRICTIONS AND CONDITIONS OF SERVICE
4.1. In the event of receiving a gift that is part of a promotion, please be aware that it can only be received and used by you as the purchaser and cannot be endorsed or transferred to another person, even if they are a family member or friend.
4.2. The team at TOTAL DEFINER BEAUTY SPA reserves the right not to perform, change, and/or suspend procedures for health reasons of the patient, without this implying non-compliance on the part of the Company.
4.3. The team at TOTAL DEFINER BEAUTY SPA reserves the right not to perform procedures on minors under the age of eighteen (18).
4.4. Regardless of whether a treatment is purchased through the platform, all treatments are subject to prior assessment at the time of the treatment application. If not suitable, another treatment will be offered for which you are eligible.
4.5. The frequency of appointments varies according to the type of treatment.
4.6. The treatment does not include girdles, kits, towels, or any other concept not indicated for the treatment. Therefore, if required for the performance of the treatment, it must be paid for by the patient at the beginning of the treatment.
4.7. The number of appointments and the frequency of attendance, as indicated in your treatment, must be judiciously followed from the day of the first session in order to achieve the expected results.
4.8. Appointments should not be rescheduled, except in special cases, with a frequency higher or lower than recommended because it may affect the results of the treatment.
4.9. If your treatment is body-related, you must purchase the sanitation kit in the first session. This must be brought to each of the sessions of the purchased treatment. Kits purchased outside of the SPA are not accepted.
4.10. Once the purchase is made, its validity will be six (6) months. This means that you will have up to a maximum of six (6) months to start your treatment.
4.11. Payment for treatments is not transferable and/or endorsable to third parties.
5. PAYMENT METHODS FOR ACQUISITION OF SERVICES
The products and services offered at TOTAL DEFINER BEAUTY SPA, unless a different method is indicated for specific cases or offers of certain goods or services, can only be paid for with PayPal and Mercado Pago.
In the case of making a payment with credit cards, the COMPANY will request the USER’s identification document number, in order to perform a fraud risk validation with banking entities and ensure integration with the various payment gateways.
Under any suspicion and/or confirmation of unauthorized purchases, the COMPANY will cancel the purchase, automatically reverse the charge to the card, and is authorized to initiate legal action against the person who carried out the suspicious transaction. Likewise, the COMPANY may, in terms of the law, provide the personal information of the person who carried out the suspicious transaction to the affected cardholders.
After a purchase is made, the patient will receive the electronic invoice in their email on the next business day. On non-business days, it may take two (2) to three (3) business days.
6. ABSOLUTE CONTRAINDICATIONS.
The technologies we use are not suitable for pregnant or breastfeeding women, nor for people with diseases or heart or kidney failure, high blood pressure, ulcers, gastric problems, diabetes, surgeries less than 3 months ago, wounds on the skin or very sensitive skin. For specific conditions or diseases, please consult whether the treatment of interest is contraindicated. In all cases, an evaluation will be carried out before starting your treatment to identify not only the best aesthetic treatment option for your case, considering your condition, particularities, and expectations but also to determine if the desired treatment is contraindicated for you. Consequently, you as a patient commit from now on to tell the complete truth about your current health conditions, history, medication, any diagnosed illness, or any information about your general health status; otherwise, you assume responsibility in case the treatment has any harmful effect on your health.
7. EXPECTATION OF ANTICIPATED RESULTS.
All aesthetic treatments are adjunctive, which means they contribute or assist supplementarily to the solution of an aesthetic problem.
Although various studies prove the efficacy of the technologies used at TOTAL DEFINER BEAUTY SPA, such results may vary due to different factors such as healing, skin quality, muscle tone, pre-existing irregularities and asymmetries, previous medical and surgical treatments, genetic type, the degree of adherence to the recommendations regarding better exercise, eating, and rest habits, or simply due to a lack of judgment in attending appointments as frequently as indicated. In patients with hormonal disorders (polycystic ovary syndrome, menopause, hirsutism, diabetes, morbid obesity, metabolic disorders, hypercholesterolemia, hypothyroidism, hypertriglyceridemia), these factors may lead to delayed treatment progress or outcomes.
The patient must always follow the instructions before, during, and after the procedure, which will be provided by the professionals as appropriate. Otherwise, you assume responsibility if the treatment does not produce the desired results or even produces some harmful effect on your health.
Therefore, the success of the results depends on different factors, and it is not guaranteed that they will meet the patient’s expectations.
8. RIGHT OF WITHDRAWAL
The COMPANY offers its USERS the possibility to withdraw from the purchase within five (5) business days following the purchase provided that the treatment and/or service has not been scheduled. The refund will be made within the following 30 business days in accordance with Law 1480 of 2011. To manage the withdrawal, it must be communicated by email to tdbeauty@totaldefiner.com, writing “Withdrawal” in the subject line and including personal details and purchase information in the content of the email.
9. PROMOTIONS
Promotions offered through any means may not necessarily be the same as those offered through other sales channels, such as physical stores, telephone sales, catalogs, or others. The COMPANY subjects its promotions and promotional activities to compliance with current regulations, specifically the provisions of Law 1480 of 2011.
In addition to the general terms and conditions established in this document, when the COMPANY carries out promotions on billboards, radio, television, or other advertising media, the following specific Terms and Conditions also apply:
- The use of the discount coupon is completely free.
- When discount coupons are offered, the advertising will indicate the value of the coupon, the minimum purchase amount to redeem the bonus, and the valid dates for its redemption.
- The discount coupon applies to purchases made exclusively on the page https://www.totaldefinerbeauty.com/
- Any natural person over the age of eighteen (18) can use the discount voucher.
- The discount coupon is not valid for gift cards or corporate sales. Corporate sales are understood to be all those sales made to legal entities.
- It is not cumulative with other promotions.
- The use of the voucher can only be used once for each USER.
- By making a purchase with the coupon, it is understood that the USER has fully accepted this Agreement.
10. CHANGES TO TERMS AND CONDITIONS
The COMPANY reserves the right to make changes to these terms and conditions. Any changes will be notified in advance and will come into effect on the specified date.
NOTIFICATIONS
Any comments, concerns, or claims regarding the foregoing Terms and Conditions, the Privacy Policy, or the execution of any of these, must be notified in writing to the COMPANY at the following address: tdbeauty@totaldefiner.com
